Identify govt.lands: HC to collectors

Sub-Registrar asked to stop the registered govt. Properties by third parties

The collectors of 33 districts in the state of Telangana were instructed by the Telangana High court on 4th August, to identify government lands in their respective jurisdictions. This bid by the government is done to protect the land from land sharks. Furthermore, the collectors are responsible for informing the concerned sub-registrars about such government land parcels. The Sub-Registrars should not execute sale deeds relating to any of these government lands by third parties, according to a bench consisting of Chief Justice Hima Kohli and Justice B. Vijaysen Reddy. While hearing a PIL case about the alleged encroachment of Waqf lands of almost 130 acres in Patancheru village, Sangareddy district, on the outskirts of Hyderabad, the court gave the respective orders. Three social activists filed the plea, stating that certain private individuals were occupying the area illegally and requesting that the lands be protected.

“The court constantly notices that various parcels of government lands in different areas of the State are being illegally encroached upon,” the CJ said when the case came up for hearing. “Fraudulent sale deeds are being executed and registered in favor of other parties,” the CJ added, “while the government fails to take appropriate actions to preserve such land parcels.

”In light of this, the bench decided to broaden the scope of the PIL petition and issue explicit instructions to the authorities. The court ordered the Collectors to begin surveying government lands in their respective areas as soon as possible. The information about government lands must be compiled and kept in a registry. Geo-survey data of areas is mandated to be included in the record.

All such government lands should be reported to the appropriate Sub-Registrars. The bench made it clear that they should not have third parties execute sale documents for these properties. The panel ordered that each District Collector produce separate affidavits describing the actions taken to perform the survey and protect government property before the next hearing date.

Hima Kohli, the Chief Justice of India, stated emphatically that the process of identifying government lands should begin immediately. The bench directed Advocate General B.S. Prasad to issue a directive to the District Collectors and ensure that the instructions are followed within one week.
