Properties Mutation on Dharani Rules 2020 Granted by Telangana

On Thursday, the Telangana government introduced a GO incorporating the amendments to the Municipalities Act to make property mutations of non-agricultural properties official through the Dharani portal.

The new Mutation of Property through Dharani Portal Rules 2020 were applicable to all municipalities and municipal corporations except GHMC.

Powers are granted to municipalities and municipal corporations in the GO provided by the municipal administration department for the digital planning, maintenance and updating of the registration of rights of non-agricultural properties through the Dharani portal. The GO was released as the state government agreed, through the Dharani portal, to register both agricultural and non-agricultural properties.

The GO specified that the record of non-agricultural property rights would include information such as the name of the owner, the names of the family member entitled to a succession of the property, details of the location, type, use and extent of the property, other information of the owner needed to confirm his identity and members of his family and to communicate with the owner as well.

Dharani Portal Process

For all the information of non-agricultural properties and other facilities, such as the issue of building permits, occupancy certificates and the approval of plots or layouts, any civic body other than GHMC can turn to the Dharani portal.

When considering the registration process and the modification of the register of rights, the Government has declared that any person planning to transfer or acquire interest by way of sale, donation, mortgage or exchange of any non-agricultural property under a registered document will have to apply after obtaining a no-dues certificate from the relevant municipality and the respective power distribution company. Later, via the Dharani portal, they may apply to register the property with the sub-registrar for slot booking.

After collecting mutation charges, the sub-registrar will allot a date via the portal and register the document. The mutation shall be made immediately by removing from the account of the transfer or the property protected by the document and by restoring the same to the account of the transferee in the event of sale, gift and exchange. The charge generated would be recorded in Dharani in the case of a mortgage.

As amended on the Dharani portal, the municipal administration department stated every municipality would have access to the latest record of rights and would use this record of rights alone for house tax purposes under sections 82 to 85 of the Telangana Municipalities Act, 2019.
