Direct Telangana To Implement RERA Provisions : Petitioner To HC
In observation, the state government has not shown any concern towards implementing the Real Estate Regulation and Development Act, 2016. M Padmanabha Reddy, Forum for Good Governance reached the high court to direct the state to enforce the provisions of the Act in letter and spirit.
His plea, filed as a PIL, appeared before a bench of Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar Shavil which gave notices to the state and its principal secretary, municipal administration, wanting them to file their counters within four weeks.
The petitioner said that there should be a regulatory administration and members for the new real estate regime to begin its functioning effectively.
Reddy said RERA reforms the real estate sector and encourages greater clarity and responsibility, it helps in ordinance and growth of the real estate sector and assures the plot sales legitimately, and retains the interest of the purchaser.
The petitioner said that sections 201 and 431 of the RERA Act have made it mandatory for the state to appoint the chairman and members and also an appellate judiciary over this body. He strived for a way for the state to bring into operation the authority by making mandatory appointments.
